ORAL COMMUNICATIONS
Members of the public may address the City Council at this time. No action will be taken on non-agenda items at this meeting. Speakers should limit comments to three (3) minutes each.
PRESENTATIONS
An informative presentation will be given by Audra McDonald, Administrative Analyst, regarding the process of grants and the mechanics of the federal stimulus money and its distribution to cities.
CONSENT CALENDAR
All items listed on the Consent Calendar are considered to be routine by the Council and will be enacted with one motion. There will be no separate discussion of these items unless a specific item is removed from the Consent Calendar for further discussion and possible action.
1. Actions
Although the live recording is the official record of public meetings, actions are prepared for the Council's approval.
Recommended Action
Approve the actions from the July 21, 2009 City Council meeting.
2. Expenditures
Warrants in the amount of $663,305.40 and payroll in the amount of $225,603.79 for a total expenditure amount of $888,909.19 are submitted for City Council approval.

GENERAL BUSINESS
3. Formation of a Utility District
The City of Avalon is being asked to contribute $10,000 to go toward a financial analysis on the feasibility of forming a utility district with four other stakeholders.
Recommended Action
Discuss and give direction to staff.
4. Appeal of a Planning Commission Decision Denying a Conditional Use Permit at A-24, Bahia Vista
At its June meeting the Planning Commission denied the application for a new Conditional Use Permit at A-24, Bahia Vista.
Recommended Action
Uphold the Planning Commission denial of the application for a Conditional Use Permit for a transient rental at A-24, Bahia Vista.
5. Residential Vehicle Permit- Sampson Family
A Residential Vehicle Permit belonging to Stan Sampson expired on April 1, 2009 after his passing. His son, Lorenzo Sampson, is looking for a legal way to transfer the permit to a family member.
Recommended Action
Listen to the Sampson Family's request, discuss any possible actions, and give direction to staff.
6. Joe Machado Field / Romtec
Assembly Bill 642, passed in January 2009, amended the Public Contract Code to allow cities to utilize design/build for public construction with some very restrictive guidelines. The first criterion is projects have to cost an excess of one million dollars. Since the concession/restroom building does not fall within that criterion, staff is proposing to precede forward with the Romtec plans that were presented previously.
Recommended Action
Authorize issuing a Purchase Order for a Romtec building.
7. Selection Process for a New City Attorney
Interim City Manager Steve Hoefs has been researching different options for the City of Avalon to pursue in securing a new City Attorney. City Council will be given an update on the information he has gathered.
Recommended Action
Listen to presented information, discuss, and give further direction to Interim City Manager.
